WHEREAS, it is the intent of the City to comply with all such environmental laws, rules and regulations for the benefit, welfare, and best interest of the citizens of Bronte;
THEREFORE, BE IT ORDAINED AS FOLLOWS:
F. COLLECTION CHARGES:
The monthly rates and charges shall be, to-wit:
(a) Premises within city limits used for private residences, single or double unit apartment houses, single mobile home sites and/or locations, shall be charged $19.75 per family unit as to occupied residences, apartments, and units. One polycart container will be provided for each trash service location. Each additional polycart shall be $19.75 per polycart.
(b) Premises within city limits used for commercial business, and/or public purposes not received sanitation container service as described herein shall be charged $31.50 per month. One polycart container will be provided for each trash location. Each additional polycart chall be $31.50 per polycart.
(c) Commercial and residential premises located outside the City Limits shall be charged at a rate of 1.75 times above the rate charged within city limits.
(d) If a polycart is lost or damaged by the resident, a $70.00 replacement fee will be assessed.
H. CONTAINERIZED SANITATION SYSTEM:
1. After the effective date of this ordinance, certain public, business and/or commercial locations and sites shall receive sanitation container system service for the removal of garbage and trash under the rates and rules hereinafter set forth. A residential service may be allowed sanitation container system service on a short time basis. Pursuant to sanitation container system services, the City will furnish a container or containers to be used in the collection and/or removal of garbage and trash. The following formula shall be used as to the fees charged for garbage and/or trash hauling, to-wit:

Charges for two pickups per week shall be charged at a rate of 1.5 times above the rate charged for one pick up per week.
I. CONVENIENCE CENTER
A monthly Convenience Center Fee of $2.00 shall be added to each sanitation service account. The fees will be used to pay for the collection and disposal of items collected at the Convenience Center.
Bulk items such as furniture, refrigerator, etc., may be disposed of at the Convenience Center. Trash, tree limbs, grass and weeds, may not be disposed at the Center. Location of the Center is 117 West Jackson. It is available only on the 1st and 3rd Saturday of each month from 8:00 am to noon.
Civilians that pay the monthly Convenience Center Fee are required to bring their current month's City of Bronte water bill to the center. Civilians that choose to utilize the center and do not have a City of Bronte water bill are required to pay a fee of $5.00.
J. METHOD OF BILLING
City shall, through its garbage and water departments, include the fees for the services herein provided on monthly bills to such persons and receiving water from the City. In the event any person is not receiving water services, the charges for the garbage services shall be directed to the person receiving garbage service.
K. PROHIBITION AGAINST BURNING OF TRASH, LEAVES, AND/OR GARBAGE
All open air burning of trash, leaves, grass, shrub clippings, and/or other garbage is specifically banned and prohibited form the effective date of this ordinance.
L. SEVERANCE OF PROVISIONS
In the event any provision of this ordinance shall be deemed invalid, all remaining provisions of the ordinance shall remain in full force and effect.
1. PENALTY FOR VIOLATION OF ORDINANCE
Any person, firm corporation, or association who violates any of the provision of this Ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be punished by a fine of not more than two hundred dollars ($200) and each and every day of continuance thereof shall constitute a distinct and separate offense.
Violation of any of the terms or provisions of this ordinance by any corporation or association shall subject the officers and agents actively in charge of business of such corporation or association to the penalty herein provided.
In addition to the penal remedy herein, the City Attorney shall, upon the direction of the City Council, institute any appropriate action or proceeding, including actions for injunction to prevent, restrain, correct, or abate any act, conduct, work, business, practice or use which is a violation of and illegal under this ordinance.
N. REPEAL OF CONFLICTING ORDINANCES
All ordinances in conflict herewith shall be and the same are hereby repealed to the extent of any conflict with this ordinance.
This ordinance shall be effective as of October 1, 2015.
